1. Who can use OpoFit

You must be at least 13 years old. If you are 13 to 17, you need permission from a parent or guardian, who agrees to these terms on your behalf, and some features work differently for you (see the Privacy Policy): photo check-ins are off, GLP-1 mode is not offered, your targets are conservative, and coach contact is only by invitation. You are responsible for your account, for keeping your password safe, and for everything that happens under your account. Tell us right away at support@opofit.net if you think someone else has accessed it.

2. What OpoFit is, and isn't

OpoFit is a tool for tracking training, nutrition and progress. It is not medical advice and does not diagnose, treat, cure or prevent any condition. Please read the Disclaimer, which is part of these terms. Talk to your clinician before changing your diet, exercise or medication.

3. Your data and privacy

Our Privacy Policy explains what we collect and how we use it. You own the content you put into OpoFit (logs, photos, messages, notes). You give us a limited license to store, process and display it only as needed to run OpoFit for you, including sharing it with a coach or clinic when you set that up.

4. Coaches

Coaches on OpoFit are independent professionals, not employees or agents of OpoFit. We don't supervise, endorse or guarantee any coach or their advice. Coaches must follow the Coach Agreement. You decide whether to link with a coach and can unlink at any time. If a coach behaves inappropriately, tell us at support@opofit.net.

5. Clinic sharing

You can choose to share a weekly summary with your clinic, as described in the Privacy Policy. It is off unless you turn it on, and you can turn it off at any time. Your clinic is not part of OpoFit, and its handling of what it receives is governed by its own practices.

6. Subscriptions and payments

• Client subscription: purchased through Apple's App Store and subject to Apple's terms. It renews automatically until you cancel in your Apple ID subscription settings. Refunds are handled by Apple.
• Coach plan: coaches pay OpoFit on this website, monthly, as set out in the Coach Agreement.
• Payments between clients and coaches: any payment for coaching happens outside OpoFit and is solely between the client and the coach. OpoFit is not a party to it and is not responsible for it.

We may change prices with advance notice. A change applies from your next billing period.

7. Acceptable use

You agree not to:

• Upload photos of anyone other than yourself, or any sexual content, or content involving minors.
• Harass, threaten or abuse anyone, including coaches and other users.
• Break the law, or use OpoFit to promote steroids, banned substances or unsafe practices.
• Try to access other people's accounts or data, or probe, disrupt or overload our systems.
• Copy, resell or reverse engineer OpoFit, or scrape it with automated tools.

8. Suspension and termination

You can stop using OpoFit and delete your account at any time (see Delete Account). We may suspend or close an account that breaks these terms, puts others at risk, or where the law requires it. Where reasonable, we will tell you why.

9. Changes to OpoFit and these terms

We may update OpoFit and these terms. If a change to the terms is material, we will tell you in the app or by email before it takes effect. Continuing to use OpoFit after that means you accept the new terms.

10. Disclaimers

OpoFit is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Nutrition information from food databases may be incomplete or wrong. We don't promise that OpoFit will be uninterrupted or error free, or that it will produce any particular result.

11. Limitation of liability

To the fullest extent the law allows, OpoFit and OPORX LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any injury or health outcome resulting from exercise, diet or advice you follow. Our total liability for any claim relating to OpoFit is limited to the greater of the amount you paid us in the 12 months before the claim or $100. Some places don't allow these limits, so they may not apply to you.

12. Indemnity

You agree to defend and hold harmless OPORX LLC from claims arising from your misuse of OpoFit or your breach of these terms.

13. Governing law

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Kentucky, and you and we consent to their jurisdiction. [Venue and dispute resolution pending legal review.]

14. Apple

If you use OpoFit on an Apple device, these terms are between you and OPORX LLC, not Apple. Apple is not responsible for OpoFit or its content, has no obligation to provide support for it, and is a third-party beneficiary of these terms with the right to enforce them against you.
